1. Who this policy covers
This Privacy Policy explains how Fire Up LLC, doing business as NY Biennial Filings, 3001 Shore Parkway, Brooklyn, NY 11235, collects, uses, shares and protects information in connection with nybiennialfilings.com and our filing service.
2. Information we collect
Information you give us — business name, NY DOS ID, entity type, business and principal addresses, service-of-process address, number of directors, the name and title of the person filing, email address, telephone number, and your typed electronic signature.
Payment information — payments are processed by Stripe. We receive confirmation of payment and limited details such as the last four digits of your card and billing name. We never receive or store your full card number.
Information from public records — when you type a business name, we query New York State's Open Data portal, which publishes Department of State business records. That data is already public.
Technical information — IP address, browser and device type, pages viewed and referring links, collected through Google Analytics (GA4) and our host, Netlify.
Communications — emails, Telegram messages and form messages you send us.
3. Why we use it
- To prepare and transmit your Biennial Statement to the New York Department of State;
- To take payment and issue receipts and refunds;
- To send you confirmations, filing records, and deadline reminders for future filings;
- To answer your questions and provide support;
- To keep records required for tax, accounting and legal purposes;
- To detect fraud, protect the service, and improve the website.
Our lawful bases, where applicable, are performance of our contract with you, our legitimate interests in operating and securing the service, compliance with legal obligations, and your consent for marketing email.
4. Filings become public record
Please understand this before you order. The information in a Biennial Statement — including the business address, the service-of-process address, and the name of the person who signs — is filed with the New York Department of State and becomes part of the public record, searchable by anyone. That is a consequence of the filing itself, not of our service, and it applies equally if you file directly with the State.
5. Who we share it with
- New York Department of State — the information necessary to make your filing;
- Stripe — to process your payment;
- Netlify — website hosting and form delivery;
- Google Analytics — aggregate website usage;
- Our email provider — to deliver confirmations and correspondence;
- Professional advisers and authorities — where required by law, subpoena, or to establish or defend legal claims.
We do not sell your personal information, and we do not share it for cross-context behavioural advertising.
6. Marketing email
We may email business owners about New York filing deadlines. Every such message identifies us, includes our postal address, and offers a working way to unsubscribe. If you unsubscribe, we suppress your address permanently and you will not be emailed again. Service messages about a filing you ordered are not marketing and are sent regardless.
7. How long we keep it
We keep filing records for at least seven years, so we can prove what was filed, when, and on whose authorization — this protects you as much as us. Payment records are kept as long as tax and accounting rules require. Analytics data is retained per Google's default retention settings. You may ask us to delete information we are not required to keep.
8. How we protect it
The website is served over HTTPS. Payment card data is handled entirely by Stripe, a PCI-DSS Level 1 service provider. Access to filing records is limited to personnel who need it. We maintain reasonable administrative, technical and physical safeguards consistent with the New York SHIELD Act. No system is perfectly secure, and we cannot guarantee absolute security. If a breach affecting your information occurs, we will notify you as required by law.
9. Your choices and rights
You may ask us to access, correct, or delete your personal information, to stop marketing email, or to receive a copy of what we hold. Email connect@fireup-llc.com and we will respond within 30 days. We will not discriminate against you for exercising these rights.
Depending on where you live you may have additional rights — for example under the California Consumer Privacy Act or, if you are in the EU or UK, under the GDPR. We honour those requests regardless of where you are. Note that information already filed with the State cannot be withdrawn from the public record by us.
10. Cookies and analytics
We use Google Analytics (GA4) to understand how the site is used, and browser localStorage to
save your form draft and remember your chosen language so we can show you the right pages. You can clear these
at any time in your browser settings, and can opt out of Google Analytics using Google's browser add-on. We do
not run advertising trackers.
11. Children
This service is for business owners and is not directed to anyone under 18. We do not knowingly collect information from children.
